Terms of Service

1. Agreement to Terms

By creating an account on or using Nexlink (nexlink.ph), including the website and mobile application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the service. Nexlink is owned and operated by Manaty ITS Corp., a corporation registered with the Philippine Securities and Exchange Commission (SEC Registration No. CS201007922).

2. Eligibility

• You must be at least 13 years old to use Nexlink.
• If you are under 18, you must have the consent of a parent or legal guardian.
• You must provide accurate and truthful information when creating your account and completing identity validation.
• You may only maintain one personal account.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Keep your password secure and not share it with others.
• Notify us immediately at support@nexlink.ph if you suspect unauthorized access.
• Not impersonate another person or create an account on behalf of someone else without their permission.

4. Identity Validation

Nexlink is built on socially validated identities. By using the platform, you understand and agree that:

• Your identity may be validated or invalidated by other users who know you personally.
• You must provide truthful identity information. Misrepresenting your identity is a violation of these Terms and may result in account suspension or termination.
• Identity validations from other users reflect their personal judgment and are not verified or guaranteed by Nexlink.
• Your validation status may be visible to other users.

5. Acceptable Use

You agree not to:

• Post content that is unlawful, harassing, threatening, defamatory, obscene, or otherwise objectionable.
• Use Nexlink to spam, phish, or distribute malware.
• Attempt to gain unauthorized access to other accounts, systems, or data.
• Use automated bots, scrapers, or other tools to access or collect data from Nexlink without permission.
• Falsely validate the identity of someone you do not personally know.
• Use Nexlink for any illegal activity under Philippine law or the laws of your jurisdiction.
• Circumvent or interfere with the security features of the platform.

6. Content You Post

You retain ownership of content you create and post on Nexlink. By posting content, you grant Nexlink a non-exclusive, worldwide, royalty-free license to display, distribute, and store your content as necessary to operate the service.

We reserve the right to remove content that violates these Terms or applicable law. Repeated violations may result in account suspension or termination.

7. Intellectual Property

The Nexlink name, logo, design, and underlying technology are the intellectual property of Manaty ITS Corp. You may not copy, modify, distribute, or reverse-engineer any part of the Nexlink platform without prior written consent.

8. Third-Party Services

Nexlink integrates with third-party services such as Google, Apple, and Facebook for authentication. Your use of these services is governed by their respective terms and privacy policies. Nexlink is not responsible for the practices of third-party providers.

9. Account Termination

You may delete your account at any time through the app settings or by contacting us at support@nexlink.ph. See our Data Deletion page for details.

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law. We will provide notice when feasible, unless doing so would compromise safety or a legal investigation.

10. Disclaimers

Nexlink is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

• We do not guarantee that the service will be uninterrupted, error-free, or secure at all times.
• Identity validations by other users are opinions, not guarantees of identity. Nexlink does not independently verify user identities.
• We are not responsible for user-generated content or interactions between users.

11. Limitation of Liability

To the maximum extent permitted by Philippine law, Manaty ITS Corp. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Nexlink. Our total liability for any claim shall not exceed the amount you paid to Nexlink in the 12 months preceding the claim, or PHP 5,000, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless Manaty ITS Corp. from any claims, damages, losses, or expenses (including legal fees) arising from your use of Nexlink, your violation of these Terms, or your violation of any third-party rights.

13. Governing Law and Disputes

These Terms are governed by the laws of the Republic of the Philippines. Any disputes arising from these Terms or your use of Nexlink shall be resolved in the courts of competent jurisdiction in the Philippines. Before filing any legal action, you agree to attempt to resolve the dispute informally by contacting us at support@nexlink.ph.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the Nexlink app or by email at least 15 days before the changes take effect. Continued use of Nexlink after the updated Terms take effect constitutes acceptance. If you do not agree with the changes, you may delete your account.
